Welcome to the Privacy Policy for the DressDecode services provided via the DressDecode application (or “app”) and website with a homepage located at www.DressDecodeApp.com (collectively, the “Services”). The Services are provided and operated by DressDecode, Inc., including any current and/or future affiliate entities (collectively, “DressDecode,” “we,” “us,” or similar terms).

This Privacy Policy (the “Policy”) describes the types of information DressDecode may collect from you or that you may provide when you access or use the Services, and how we collect, use, protect and disclose that information. This Policy applies to information collected on or through the Services, including via our website or app. It does not apply to information collected by us offline or through any other means. By choosing to access or use the Services, you agree to the terms of this Policy, and our use, sharing or disclosure of information as described below or in any revisions to this Policy. If you do not agree with the practices described in this Policy, you may choose not to access or use the Services.

The Services may contain links to the websites of third parties. We are not responsible for the practices or security of other entities or their sites. Please review the privacy policies of such third parties before sharing your information.

Information Collection

The types of information we receive and/or collect about you through the Services may include:

·      Information by which you may be personally identified, such as your image or likeness, your name, email address, social media account information, telephone (including mobile phone), as well as other demographic information you may provide  (“personal information”);

·      Information about the garments you purchase and wear, including the size, brand, style, fabric, and other details of such garments;

·      Information about how the garments you purchase and wear are worn, including images of you wearing the garments, how often the garments are worn, who the garments are worn in front of, and when the garments were worn;

·      Information you provide to Third Party Services (defined below), including the provider of your digital calendar;

·      Information about your interest in the Services;

·      Your activity in accessing or using the Services, including details of transactions you carry out through the Services;

·      Information about your smart phone connectivity provider, internet connection, the equipment you use to access the Services, and details regarding your usage of the Services;

·      Location information; and

·      Records and copies of correspondence, if you contact us.

We collect this information directly from you when you provide it to us by, for example,  filling out forms via our website or app, creating an Account with us, submitting photographs via the Services, submitting notes via the Services, connecting your DressDecode account to Third-Party Services, or submitting other content via the Services. We may collect certain information about users of the Services automatically and through automated means, including personal information, information about your mobile device and internet connection, your IP address, the equipment you use to access the Services, and usage details.

We may also collect non-personal information automatically as you navigate through the Services, using technologies such as cookies and analytics software. 

·        Cookies (or browser cookies) and Cookie Opt-Out. A cookie is a small file placed on the hard drive of your computer. You may refuse to accept browser cookies by activating the appropriate setting on your browser. However, if you select this setting you may be unable to access certain parts of the Services. Unless you have adjusted your browser setting so that it will refuse cookies, our system will issue cookies when you direct your browser to the Services. ·        Flash Cookies. Certain features of the Services may use local stored objects (or Flash cookies) to collect and store information about your preferences and navigation to, from, and on our application or website. ·        Web Beacons. Pages of our website or app and our e-mails may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit DressDecode, for example, to count users who have visited those pages or opened an email and for other related website statistics (for example, recording the popularity of certain website content and verifying system and server integrity).

We use the information gathered through these technologies and methods to improve your user experience, provide you relevant information about third party services, analyze trends, track visitor movements, diagnose problems, gather information on visitor preferences, and tailor the Services to better meet your individual tastes. 

We do not respond to “do-not-track” signals or other mechanisms that allow users to signal their preferences on the collection of their personal information over time and across third-party websites or online services. Our website and app do not monitor for or adjust any use as the result of “do-not-track” signals.

How We Use the Information We Collect

We may use the information we collect about you, including your personal information, to:

·      Provide you with information about the Services, including recommendations based on your user content;

·      Provide customer support for the Services, permit service and customer satisfaction evaluations, or otherwise manage our relationship with you;

·      Notify you about changes to the Services or regarding the terms of the Services;

·      Communicate with you by text, e-mail, postal mail, telephone, or mobile device, or social media or messaging account, about the Services and/or any related item, including through any third party service provider we work with;

We may use aggregated or de-identified information that does not identify you personally for any legal business purpose.

We may disclose or share your information, including personal information, with any of our subsidiary, affiliate, or successor entities, with prospects or other companies with which we have a strategic relationship, and with vendors, suppliers or other companies that perform work necessary for us to provide the Services to you (including third party communication managers and those that assist us in improving the Services we offer). We may also share your information for any other purpose disclosed by us when you provide the information or as may be requested or consented to by you. We may share or sell aggregate and de-identified information that does not identify you personally without restriction.

We may share or transfer your personal information if all or part of our business is sold, merged, dissolved, acquired, reorganized, or subject to a similar transaction. We also reserve the right to disclose your information as necessary to comply with a subpoena or similar investigative demand, court order, request for cooperation from law enforcement or other governmental agency, to exercise our legal rights, to defend against legal claims, or as otherwise required by law, and/or to protect the rights or interests of third parties.

Third Party Services; Social Media

One of the special features of the Services is that it allows you to enable various online third party services, such as your digital calendar provider ("Third Party Services"), to be directly integrated into your DressDecode experience. To take advantage of this feature, we may ask you to provide us your username and password for the relevant Third Party Services. By enabling such Third Party Services, you are allowing us to pass your login information to these service providers for this purpose. When you add a Third Party Service account to the Services, we will collect your login information and other relevant information necessary to enable the Services to access that Third Party Service and your data contained within that Third Party Service. As part of such integration, such Third Party Services will provide us with access to certain information that you have provided to such Third Party Services, and we will use, store and disclose such information in accordance with this Privacy Policy. However, please remember that the manner in which Third Party Services use, store and disclose your information is governed solely by the policies of such third parties, and we shall have no liability or responsibility for the privacy practices or other actions of any Third Party Service that may be enabled within the Services.

The Services may, now or in the future, include buttons or links that permit you to share and post information on social media platforms such as Facebook, Instagram and Twitter. Any postings on these third party platforms are governed by the terms, conditions, and privacy policies of such third parties.

Security

We value your trust in providing us your personal information, but no method of transmission over the internet, or method of electronic storage is 100% secure and reliable, and we cannot guarantee its absolute security. While we take steps to secure your personal information, we do not promise that your personal information or activity will always remain secure. We are not responsible or liable for the illegal acts (such as hacking) by third parties.

Children’s Privacy

The Services are not intended for anyone under the age of 13. We do not knowingly collect personal information from individuals under 13. No one under the age of 13 may provide personal information to or via the Services. If we learn we have collected or received personal information from a child under 13 without verification of parental consent, we will delete that information. Changes to This Privacy Policy

We may update our Privacy Policy from time to time. Thus, you are advised to review this page periodically for any changes. If there are any changes to our Privacy Policy, we will post the new Privacy Policy on this page and update the “Last Updated” date at the top of the page. These changes are effective immediately after they are posted on this page. Continued use of the Services after any changes constitutes acceptance of those changes.

California Privacy Rights

California Civil Code Section § 1798.83 permits users of the Services that are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. We are an entity located in the United States, and the servers and other technology supporting the operations of this Website are located in the United States. The Services are intended exclusively for a U.S. audience and users. If you submit any personal information to us through the Services (for example, if you provide your email in order to contact us) you understand that you are voluntarily consenting to the transmission of such information to an organization in the United States and your information will be stored and processed in the United States. We agree only to be subject to applicable U.S. laws and not to the laws of any other country or region.
